Terms of service
Who we are
refDrop (refdrop.to) is run by REFERN LABS INC. ("we", "us"). These terms cover the refDrop website and service. By making an account, opening a box link, sending a request, or uploading a file, you agree to them. If you do not agree, do not use refDrop.
refDrop accounts are refern online accounts. If you also use refern, the refern terms cover refern itself.
The service
refDrop lets an artist who takes commissions make drop boxes. The artist sends a client a private box link. The client adds references and notes through that link without an account, and the artist sends finished files back through the same link. Artists can also have a public page with their commission details and a request form.
refDrop never handles payments. Any payment between an artist and a client happens somewhere else, and is between them. We are not a party to a commission, and we do not check, promise, or guarantee the work, the price, or the delivery.
Your account
- You need to be at least [minimum age, to be decided] to make an account.
- Sign-in uses a code sent to your email. Keep your email account safe: anyone who can read it can sign in as you.
- Your username is your public page address (refdrop.to/your-name). It is shared with refern. We may refuse or take back a username that impersonates someone, misleads, or infringes a trademark.
- During the beta, free spots are limited. When they are taken, new accounts join a waitlist, and an invite code or an opened spot lets them in.
Box links
Anyone who has a box link can see that box, add files to it while it is open, and download its files. Share a link only with your client. You can close a box or make a new link at any time, and the old link stops working.
Plans and limits
The free plan has limits on open boxes, storage per box, total storage, and how long files are kept after a box closes. The current limits are on the pricing page. We may change the limits. A change never closes a box that is open.
Paid plans are not available yet. When they are, their prices, billing, renewals, and refunds will be added here before anyone can buy one. [Refund policy, to be written before paid plans launch.]
How long files are kept
A closed box keeps its original files for the hold period of your plan (now 3 months on the free plan). We email the artist, and the client if they left an email, 30 days and 7 days before the originals are removed. After that the box becomes an archive: images keep their small previews, and other files (such as PSD, video, or PDF) keep only their name, type, and size. An archive stays until the artist deletes it.
Keep your own copies of anything that matters to you. refDrop is not a backup service.
Your content
You keep all rights to what you upload. You give us permission to store, copy, resize (for previews), and show your content only as needed to run refDrop for you and the people you share it with. For example, we make previews of images and show your public page to its visitors.
You promise that you have the right to upload what you upload, and that it follows these terms.
Content rules
You must not use refDrop to upload, share, or link to:
- Child sexual abuse material, or any sexual content involving minors, including drawn, painted, or generated content. We remove it, close the account, and report it to the National Center for Missing and Exploited Children (NCMEC) and the authorities as the law requires.
- Anything illegal where you or the recipient are, or anything that infringes someone else's copyright, trademark, or other rights.
- Malware or files meant to harm a computer. refDrop blocks programs and scripts, but it does not scan files for viruses.
- Harassment, threats, hate, or content that shares someone's private information without their consent.
- Spam, scams, or attempts to trick people out of money or information.
Adult art made by and for adults is allowed in private boxes and requests. On a public page, adult examples must be marked as adult, so they show only after the visitor clicks through a notice. They never appear in link previews.
You must not try to get around limits, get into boxes or accounts that are not yours, overload the service, or use automated tools to make accounts or send requests.
Copyright notices
If you believe content on refDrop infringes your copyright, send a notice to our designated agent with: your contact details, the work you own, the refDrop link where the infringing content is, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate, and your physical or electronic signature.
Designated agent: [DMCA agent name, address, and email, to be added once the agent is registered with the US Copyright Office].
We remove content after a valid notice and may close the accounts of repeat infringers. If your content was removed by mistake, you can send a counter-notice to the same address.
Ending your account
You can stop using refDrop at any time. To delete your account and your data, write to us at [support email]. We may suspend or close an account that breaks these terms, puts others at risk, or puts us at legal risk. Where it is safe and legal, we will tell you why and give you a chance to download your files.
No warranty
refDrop is provided "as is", without warranties of any kind. We work to keep it running and your files safe, but we cannot promise it will always be available or free of errors, or that files will never be lost.
Limitation of liability
To the extent the law allows, REFERN LABS INC. is not liable for indirect, incidental, or consequential damages, or for lost profits, data, or commissions. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or [amount, to be decided].
Changes
We may change these terms. If a change matters, we will tell signed-up artists by email or in the app before it takes effect. The date at the top shows the latest version.
